2.1. Acceptance of this Agreement is effected by the Customer registering on the Platform — confirming a mobile telephone number by means of a code (OTP) — or by placing an order without registration.
2.2. The agreement is deemed concluded from the moment the action specified in clause 2.1 is performed, in accordance with part four of Article 370 of the Civil Code of the Republic of Uzbekistan.
2.3. The written form of the agreement is deemed observed in accordance with parts four and five of Article 366 of the Civil Code of the Republic of Uzbekistan.
2.4. The Customer agrees that the use of a confirmed mobile telephone number and a one-time code constitutes necessary and sufficient identification of the Customer and is recognised as a method of electronic confirmation within the meaning of part seven of Article 14 of the Law of the Republic of Uzbekistan "On Electronic Commerce". Actions performed using the Account are deemed to have been performed by the Customer.
2.5. The current version of the Agreement is permanently available on the Platform.
3.1. The Operator grants the Customer access to the Platform in order to search for goods and services of Businesses, to place and pay for Orders, to participate in the Loyalty programmes of Businesses and to receive information on the status of Orders.
3.2. The Operator acts as an intermediary between the Customer and the Business as regards the placement and transmission of Orders. The seller of goods and services is the Business. The contract of sale (or provision of services) is concluded directly between the Customer and the Business.
3.3. The Operator is not the manufacturer, seller, importer or supplier of the goods and services of the Business and is not liable for their quality, composition, completeness, weight, shelf life or conformity with the description.
3.4. Claims relating to a good or service shall be submitted by the Customer to the Business as the seller. The Operator is entitled to assist in the settlement of a dispute and shall provide the Customer with the details of the Business necessary for bringing a claim.
3.5. The services of the Platform are provided to the Customer free of charge, unless expressly stated otherwise in the Platform interface before the relevant action is performed.
4.1. Before an Order is placed, the Customer is provided, in the Platform interface, with information about the Business and the goods to the extent required by Articles 5, 6 and 28-1 of the Law of the Republic of Uzbekistan "On the Protection of Consumer Rights", including: the full name and registered address of the Business; the procedure for accepting complaints; the principal consumer properties of the goods; the price, delivery cost and payment terms; warranty obligations; the procedure for terminating the contract; and information on licences and permit documents.
4.2. The Business is responsible for the accuracy and completeness of the information published in the catalogue. The Operator provides the technical means of publication and carries out moderation of the catalogue.
4.3. Information is provided in the state language. In addition, the Platform interface and the information may be provided in Russian and English.
4.4. The publication of a catalogue item on the Platform constitutes an offer by the Business, addressed to Customers, to conclude a retail sale contract. Items marked as unavailable, as well as items included in the stop list of a point of sale, do not constitute an offer for sale.
4.5. Where a technical error is identified in the price or description of an item, the Business is entitled to reject the Order before it is accepted, notifying the Customer and stating the reason.
5.1. The sole identifier of the Customer on the Platform is a confirmed mobile telephone number. The Operator does not assign public identifiers to the Customer.
5.2. The Platform supports the following Account statuses:
| Status | How it is created | Restrictions |
|---|---|---|
| Confirmed | The Customer has confirmed the number by means of a code (OTP) | Full access, including the Loyalty programme and Order history |
| Unconfirmed | An employee of the Business has registered the Customer using the number provided verbally | Limited access; some Loyalty programme functions are unavailable until the number is confirmed |
| Guest | The Order was placed without providing a telephone number | The Loyalty programme does not apply; the Order is not linked to an Account |
5.3. The Customer must safeguard access to the telephone number and the device. The Customer must notify the Operator without delay of any loss of control over the telephone number.
5.4. The Customer is entitled to request the transfer of the Account to a new telephone number or the unlinking of the Account from a number. Transfer and unlinking are carried out following confirmation of the Customer's identity in the manner established by the Operator.
5.5. One telephone number may be used for several roles on the Platform. The data of the roles are logically separated.
5.6. The Customer's QR code contains no personal data and is a technical link that transmits the Customer's telephone number to an employee of the Business. The Customer must not provide their QR code to third parties.
6.1. The Customer creates an Order by selecting catalogue items, a point of sale, a collection method and a payment method, and confirms the Order in the Platform interface.
6.2. Confirmation of the Order by the Customer constitutes acceptance of the offer of the Business. The Business accepts or rejects the Order; where an Order is rejected, the reason is stated.
6.3. Order statuses are displayed to the Customer in the application. The Business is obliged to perform an accepted Order on the terms in force in the catalogue at the time of placement, including the price.
6.4. In-store order. An employee of the Business is entitled to place an Order on behalf of the Customer at a point of sale with the Customer's consent to the use of their telephone number. Placing an Order against a telephone number without the knowledge of its owner is not permitted.
6.5. Guest order. The Customer is entitled to place an Order without identification. In this case the Loyalty programme does not apply, the Order is not linked to an Account and no personal data are collected.
6.6. Order via a table QR code. When placing an Order via a table QR code, the Customer specifies the table number; the table QR code contains no other personal data.
6.7. The Customer is entitled to cancel an Order before it is accepted by the Business without any consequences. The procedure for cancellation after the Order has been accepted is determined by the terms of the Business and by legislation.
7.1. The price of the goods is stated in the Platform interface in the national currency, inclusive of all mandatory payments. The delivery cost, where applicable, is stated separately before the Order is confirmed.
7.2. The Platform supports: payment in cash at the point of sale, payment by bank card at the point of sale, and online payment through integrated payment services.
7.3. The price of the goods does not depend on the form of payment. Different prices for the same goods depending on whether payment is made in cash or by non-cash means are not established.
7.4. Where payment is made at the point of sale, the funds are received by the Business. The Operator is not the recipient of such funds.
7.5. Online payments are processed by licensed payment organisations. The Platform does not store full bank card numbers, CVV codes or credentials for accessing payment applications.
7.6. Fiscal receipt. The obligation to generate and issue a fiscal receipt rests with the Business as the seller. The Customer consents to receiving the fiscal receipt and other documents in electronic form — in the application, by SMS or to an email address. Documents in electronic form are equivalent to documents in paper form in accordance with Article 14 of the Law of the Republic of Uzbekistan "On Electronic Commerce".
8.1. The Loyalty programme is established and funded by the Business. The Operator provides the technical means of calculation and accounting. The obligation to grant the Customer the benefit (points, discount, reward) rests with the Business.
8.2. Points are maintained separately for each Business. Points accrued by one Business may not be used with another Business.
8.3. Points do not constitute money, electronic money or a means of payment. Points may not be exchanged for money and may not be assigned or transferred to another person, unless the rules of the Business provide otherwise.
8.4. The conditions for accruing, redeeming, the validity period and the expiry of points are established by the Business and communicated to the Customer in the Platform interface before an Order is placed.
8.5. Changes to the terms of the Loyalty programme do not apply to points accrued to the Customer before the changes take effect. Retroactive worsening of terms in respect of points already accrued is not permitted.
8.6. Where an Order is returned, the points accrued for that Order are cancelled. Points redeemed in payment for the returned Order are restored to the Customer's balance. Funds are refunded in the form in which payment was made.
8.7. The Operator and the Business are entitled to cancel points and to suspend the Customer's participation in the Loyalty programme where signs of abuse are identified: fictitious orders, the use of several Accounts by one person, the use of other people's telephone numbers, or other actions aimed at obtaining a benefit in circumvention of the established rules.
8.8. Where a Business ceases to operate on the Platform, the obligations in respect of accrued points shall be settled by that Business. The Customer is notified through the Platform at least 30 calendar days in advance.
8.9. Deletion of the Account terminates the Customer's participation in all Loyalty programmes; accrued points are cancelled without compensation.
9.1. The Customer's rights as a consumer, including the right to exchange and return goods, are exercised in accordance with the Law of the Republic of Uzbekistan "On the Protection of Consumer Rights".
9.2. Claims relating to the quality, completeness, weight, shelf life and conformity of the goods with the description shall be submitted to the Business as the seller.
9.3. Refunds are made in the form in which payment was made.
9.4. A claim relating to the operation of the Platform shall be sent to the Operator through the support section of the application or to akacorpglobaltech@gmail.com. The review period is 15 working days.
9.5. The Operator maintains a record of Customer enquiries and is entitled to request information from the Business in order to examine a disputed situation.
10.1. Service notifications — confirmation codes, Order statuses, information on changes to the terms — are sent to the Customer as part of the performance of this Agreement and do not require separate consent.
10.2. Advertising and marketing messages are sent only where separate consent has been obtained from the Customer in a form that allows the fact of its receipt to be confirmed. Consent may be withdrawn at any time through the application settings or by contacting support.
10.3. Withdrawal of consent to advertising messages does not result in deactivation of the Loyalty programme and does not restrict the Customer's access to the Platform.
10.4. Advertising messages are not sent between 18:00 and 09:00.
10.5. The Customer is entitled to configure the receipt of individual categories of messages independently of one another.
11.1. The processing of the Customer's personal data is carried out in accordance with the Law of the Republic of Uzbekistan "On Personal Data" and the Operator's Privacy Policy published on the Platform.
11.2. The Operator processes the Customer's data as regards the functioning of the Platform. The Business is an independent operator in respect of the data of its own customers.
11.3. The Business obtains access only to the data of those Customers who have placed Orders with that Business, and only to the extent necessary for the performance of the Order and the administration of the Loyalty programme. Data on the Customer's Orders with other Businesses are not transferred to the Business.
11.4. Consent to the processing of data for marketing purposes is given separately from the consent relating to the performance of an Order and may be withdrawn independently.
11.5. The Customer's rights in respect of their personal data and the procedure for exercising them are set out in the Privacy Policy.
12.1. The Customer undertakes to provide accurate information and to use the Platform in accordance with legislation and this Agreement.
12.2. The Customer is prohibited from:
12.3. When purchasing age-restricted goods, the Customer must confirm their age at the request of the Business at the point of sale.

13.2. Persons aged between fourteen and eighteen use the Platform with the written consent of their parents, adoptive parents or guardians in accordance with Article 27 of the Civil Code of the Republic of Uzbekistan.
13.3. The Operator does not intentionally collect data of persons under the age of fourteen. Where such an Account is identified, it is subject to deletion.
14.1. The rights to the Platform, its program code, design, interfaces, trademarks and documentation belong to the Operator. The Customer is granted a limited, non-exclusive, non-transferable right to use the Platform for its intended purpose for the term of this Agreement.
14.2. The Customer may not copy, decompile or modify the Platform, or use its elements outside the Platform, without the written permission of the Operator.
14.3. The rights to the names, logos and images of the goods of Businesses belong to the respective rights holders.
14.4. By posting a review, rating or other content, the Customer confirms that they hold the rights to such content and grants the Operator the right to use it on the Platform.
15.1. The Business is liable to the Customer for the quality, safety and conformity of goods and services, as well as for the performance of the Order.
15.2. The Operator is responsible for the operability of the Platform within the limits of its control. The Operator is not liable for failures caused by the actions of the Customer, their equipment, internet provider, payment systems, telecommunications operators, application stores or other external services, or by force majeure circumstances.
15.3. The limitations of liability established by this Agreement do not apply in cases where their application is not permitted by consumer protection legislation.
15.4. The Customer is responsible for the accuracy of the information provided and for actions performed using their Account.
16.1. The Customer is entitled at any time to withdraw from the performance of this Agreement by deleting their Account in the application. The Agreement is deemed terminated from the moment the Account is deleted.
16.2. Deletion of the Account does not terminate obligations in respect of Orders already placed and not yet performed.
16.3. The Operator is entitled to suspend access to an Account where breaches of clause 12.2 or signs of fraud are identified, or at the request of the competent authorities, notifying the Customer and stating the reason.
16.4. Data that the Operator is required by law to retain are kept after deletion of the Account for the periods established by legislation and by the Privacy Policy.
17.1. The Operator is entitled to amend this Agreement. The new version is published on the Platform stating the date on which it takes effect.
17.2. The Customer is notified of changes to the terms at least 30 calendar days before the changes take effect — through the application and by publication on the Platform.
17.3. If the Customer does not delete their Account before the changes take effect, the changes are deemed accepted. Continued use of the Platform constitutes agreement with the new version.
